Curiopod — Terms of Service

Welcome to Curiopod (“we,” “our,” “us”). By using our website, mobile application, or related services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

Curiopod is an AI-powered educational platform generating personalized podcasts based on your interests and learning goals. Episodes are produced automatically with Google's Gemini models for scripting and multilingual text-to-speech, so occasional inaccuracies or omissions may occur. You can generate podcasts, explore curated and community-shared episodes, listen, and save content. Features may change to improve performance or comply with law.

3.1 Account Creation

• Provide accurate information.
• Keep credentials confidential.
• Be responsible for all account activity.
• Notify us of unauthorized access.

3.2 Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction, if higher) to use Curiopod. If you allow a minor to access the Service through your account, you are responsible for their activity and for ensuring that use complies with applicable law.

3.2 Account Types

We offer the following plans:

• Free: Library access with limited listens (currently 5 per month) and access to the rotating free podcast; creation is not included.
• Curious Listener: Unlimited listening across the library; creation is not included.
• Curious Creator: Includes listening plus a monthly allowance of podcast generations (see plan details in-app).
• Pro Creator: Higher monthly generation limits and listening included (see plan details in-app).

4.1 Free Tier

Free accounts have limits on listening (currently 5 per month) and do not include generation.

4.2 Premium Subscriptions

• Payments processed via Stripe.
• Subscriptions auto-renew unless canceled.
• No refunds: All fees are non-refundable to the maximum extent permitted by applicable law. This does not affect any mandatory statutory rights (for example, consumer cooling-off rights where they apply). Cancel anytime to avoid future charges.

5.1 Prohibited Activities

• Illegal or harmful use.
• Offensive, defamatory, or discriminatory content.
• Reverse-engineering AI systems.
• Malware, hacking, or server interference.
• Automated tools without permission.
• Sharing credentials or impersonation.

5.2 Content Guidelines

• Ensure you have rights to submitted content.
• Respect IP and privacy rights.
• No promotion of violence, hate, or illegal activity.
• Be respectful in community interactions.
• Do not rely on the Service for medical, legal, financial, or safety-critical decisions without independent verification.

6.1 Our Content

Curiopod content, features, and functionality are owned or licensed and protected by copyright and trademark laws.

6.2 AI-Generated Content

AI-generated content is licensed for personal, non-commercial use. Commercial use requires our prior written permission. All scripts and audio are produced automatically using Google's Gemini models and may contain factual, contextual, or safety-related inaccuracies or omissions. You are solely responsible for reviewing, fact-checking, and disclosing the AI origin of any output before you rely on it, publish it, or share it with others, and for any consequences of how you use or redistribute that output.

6.3 User Content

You retain ownership but grant Curiopod a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to host, store, reproduce, modify, adapt, display, perform, and distribute your content in connection with operating, improving, and promoting the Service. You are responsible for ensuring you have all rights needed to grant this license.

We comply with global privacy standards (GDPR/CCPA). See our Privacy Policy for details. Contact us for data access or deletion requests.

• High availability is our goal, but not guaranteed.
• Features may be modified or discontinued.
• Usage limits may apply to prevent abuse.

• We may suspend or terminate accounts for violations.
• Your right to use the Service ends immediately upon termination.
• Certain provisions survive termination (IP, indemnity, limitations).

The Service, including all AI-generated podcasts, is provided “as-is” without warranties of any kind. We do not guarantee accuracy, completeness, or suitability of any output, and we are not liable for decisions made in reliance on the Service. Content is for informational purposes only and is not a substitute for professional, medical, legal, financial, or other professional advice. Do not use the Service in situations where inaccurate or incomplete information could lead directly to death, personal injury, or significant financial or safety harm.

To the maximum extent permitted by law, Curiopod's total aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amounts you paid to Curiopod for the Service in the twelve (12) months before the event giving rise to liability, or (b) fifty US dollars (USD $50). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence provide otherwise. Any dispute arising out of or relating to the Service will be brought in the courts located in Toronto, Ontario, Canada, unless applicable law requires a different forum.

We may update these Terms from time to time to reflect changes to the Service or applicable law. If changes are material, we will provide reasonable notice (for example via email or in-app notice). Your continued use of the Service after the updated Terms become effective means you accept them.
